The owner of a registered industrial design has the right to prevent others from making, selling, or importing things that bear or embody a design that is a substantial copy of the protected design when this is done for commercial purposes.

Thus, for an industrial design to be registerable:

  • It must be a novelty
  • It must be registered in the relevant registration with the administration
  • Submit the registration application, which is examined in accordance with the procedures specified by the internal regulations of the law.
